Pennsylvania:

The placement of identifying purple paint marks on trees or posts on the property which are:

(A)  vertical lines of not less than eight inches in length and not less than one inch in width;

(B)  placed so that the bottom of the mark is not less than three feet from the ground nor more than five feet from the ground; and

(C)  placed at locations that are readily visible to a person approaching the property and no more than 100 feet apart.

 

Main:

Posting of Land and Criminal Trespass (17-A MRSA, §402)

Property is posted if it is marked with signs or paint in one of the following ways and in a manner that is reasonably likely to come to the attention of an intruder:

  1. Signs must indicate that access is prohibited, that access is prohibited without permission of the landowner or landowner's agent, or that access for a particular activity is prohibited.

  2. One vertical "OSHA Safety Purple" stripe at least one inch in width and at least 8 inches in length means "Access by Permission Only" when it is placed on trees, posts or stones between three and five feet off the ground. These signs or paint stripes must mark the property at distances no more than 100 feet apart at locations that are readily visible to any person approaching the property, and at all vehicular access entries from a public road.

In addition, landowners may also, either verbally or in writing, personally communicate to others that access is prohibited. Remember, it is unlawful to remove, mutilate, deface or destroy a sign or paint mark that is placed in order to prohibit or restrict access; and it is unlawful to post the land of another without permission of the landowner.

 

Arkansas:

  1. Forest Land         

    • Signs - Signs placed not more than 100 feet apart and at each road entrance. The signs shall bear the words "POSTED" and/or "NO TRESPASSING" in letters at least 4 inches high. The signs shall be readily visible to any person approaching the property. 

    • Paint - Vertical paint marks at least 8 inches in length shall be placed on trees or posts no more than 100 feet apart, and at each road entrance. The paint marks shall be not less than 3 feet nor more than 5 feet from ground level, and shall be readily visible to any person approaching the property. 

  2. Cultivated Land, Orchards, Pasture Land, Impoundments, Other Same as (1) and (2) above but the distance between signs or paint marks are no more than 1,000 feet apart. 

  3. Posting Paint 

Posting paint is a purple, semi-paste, tree marking paint which meets or exceeds the following specifications:

Texas:

The Texas Penal Code 30.05 Criminal Trespass provides for the use of purple paint to mark property boundaries.  Purple markings are required to be vertical lines, 8 inches long and 1 inch wide. The bottom of the markings must be between 3 – 5 feet above the ground. Purple markings can be spaced no more than 100 feet apart in wooded areas and no more than 1000 feet apart in open areas. Markings must be placed in areas visible to anyone approaching the property. Posted signs are still recommended at all access points and gates.

Kansas: (No Hunting without Permission).

32-1013. Taking wildlife without permission on land posted "by written permission only"; penalties. (a) Any landowner or person in lawful possession of any land may post such land with signs stating that hunting, trapping or fishing on such land shall be by written permission only. It is unlawful for any person to take wildlife on land which is posted as provided in this subsection, without having in the person's possession the written permission of the owner or person in lawful possession thereof.

(b) Instead of posting land as provided in subsection (a), any landowner or person in lawful possession of any land may post such land by placing identifying purple paint marks on trees or posts around the area to be posted. Each paint mark shall be a vertical line of at least eight inches in length and the bottom of the mark shall be no less than three feet nor more than five feet high. Such paint marks shall be readily visible to any person approaching the land. Land posted as provided in this subsection shall be considered to be posted by written permission only as provided in subsection (a).

 

Illinois:

  1. A vertical line of at least 8 inches in length.  The bottom of the mark shall be between 3 feet and 5 feet high.  Each mark shall be no more than 100 feet from another such mark and be readily visible to any person approaching the property.

 

North Carolina:

14-159.7. Regulations as to posting of property. The owner or lessee of the property may place identifying purple paint marks on trees or posts around the area to be posted. Each paint mark shall be a vertical line of at least eight inches in length, and the bottom of the mark shall be no less than three feet nor more than five feet from the base of the tree or post. The paint marks shall be placed no more than 100 yards apart and shall be readily visible to any person approaching the property. For the purpose of prohibiting fishing, or the taking of fish by any means, in any stream, lake, or pond, it shall only be necessary that the paint marks be placed along the stream or shoreline of a pond or lake at intervals of not more than 100 yards apart."

 

Florida:  (with signs at entrance)

SB 132

       3.a. Identifying purple paint marks are placed on trees or posts on the property, provided that each mark is:

 (I) A vertical line of not less than 8 inches in length and not less than 1 inch in width;

 (II) Placed so that the bottom of the mark is not less than 3 feet from the ground or more than 5 feet from the ground; and

 (III) Placed so that each mark is readily visible to any person approaching the property and no more than 100 feet apart.

 b. When a landowner uses purple paint marks to identify a “no trespassing” area, those marks shall be accompanied by signs complying with subparagraph 1 (signs

   there appears prominently, in letters of not less than 2 inches

   in height, the words “no trespassing” and in addition thereto

  the name of the owner, lessee, or occupant). and placed conspicuously at all places where entry to the property is normally expected or known to occur.

 

Missouri:

569.145.  Posting of property against trespassers, purple paint used to mark streets and posts, requirements. — In addition to the posting of real property as set forth in section 569.140, the owner or lessee of any real property may post the property by placing identifying purple marks on trees or posts around the area to be posted.  Each purple mark shall be:

  (1)  A vertical line of at least eight inches in length and the bottom of the mark shall be no less than three feet nor more than five feet high.  Such marks shall be placed no more than one hundred feet apart and shall be readily visible to any person approaching the property; or

  (2)  A post capped or otherwise marked on at least its top two inches. The bottom of the cap or mark shall be not less than three feet but not more than five feet six inches high.  Posts so marked shall be placed not more than thirty-six feet apart and shall be readily visible to any person approaching the property.  Prior to applying a cap or mark which is visible from both sides of a fence shared by different property owners or lessees, all such owners or lessees shall concur in the decision to post their own property.  

Posting in such a manner shall be found to be reasonably likely to come to the attention of intruders for the purposes of section 569.140.

 

Indiana:

A) on a tree:

(i) as a vertical line of at least eight (8) inches in length and with the bottom of the mark at least three (3) feet and not more than five (5) feet from the ground; and

(ii) not more than one hundred (100) feet from the nearest other marked tree; or

(B) on a post:

(i) with the mark covering at least the top two (2) inches of the post, and with the bottom of the mark at least three (3) feet and not more than five (5) feet six (6) inches 19 from the ground; and

(ii) not more than thirty-six (36) feet from the nearest other marked post; and

 

 

Alabama:

Alabama Code Title 13A. Criminal Code § 13A-7-1

(4) Posting in a conspicuous manner.  A sign or signs posted on the property, reasonably likely to come to the attention of intruders, indicating that entry is forbidden or the placement of identifying purple paint marks on trees or posts on the property, provided that the marks satisfy all of the following:

a. Are vertical lines of not less than eight inches in length and not less than one inch in width.

b. Are placed so that the bottom of the mark is not less than three feet from the ground or more than five feet from the ground.

c. Are placed at locations that are readily visible to any person approaching the property and are no more than 100 feet apart on forest land or 1,000 feet apart on land other than forest land.

 

 

Tennessee: (with signs at entrance)

(2) Places identifying purple paint marks on trees or posts on the property; provided, that at least one (1) sign is posted at a major point of ingress to the property in a manner that is reasonably likely to come to the attention of a person entering the property and that the sign includes language describing that the use of purple paint signifies "no trespassing." If purple paint is used, then purple paint must be vertical lines of not less than eight inches (8") in length and not less than one inch (1") in width; placed so that the bottom of the mark is not less than three feet (3') or more than five feet (5') from the ground; and placed at locations that are reasonably likely to come to the attention of a person entering the property.

 

 

South Carolina ( 2 inches wide and 3 to 6 feet on tree)

by marking boundaries with a clearly visible purple-painted marking, consisting of one vertical line not less than eight inches in length and two inches in width, and the bottom of the mark not less than three nor more than six feet from the ground or normal water surface. These marks must be affixed to immovable, permanent objects that are not more than one hundred yards apart and readily visible to any person approaching the property.

Kansas 

32-1013. Taking wildlife without permission on land posted "by written permission only"; penalties. (a) Any landowner or person in lawful possession of any land may post such land with signs stating that hunting, trapping or fishing on such land shall be by written permission only.
